2. Collection, processing and use of your personal data

2.1 Personal data

Personal data is information concerning the personal or material circumstances, whether determined or determinable, of a natural person. This may be, for example, your name, telephone number, address or the data which we send to you at the time of your registration and client account creation. The static data which we collect, for example when our online shop is visited, and which cannot directly be linked to you, is not concerned here. Static data consists, for example, of statistics showing which pages of our shop are particularly popular or how many users visit certain pages of the heidi.com site.

2.2 Client account

We provide each client who registers with direct password protected access to data on his or her subject (a client account). Here you can access data concerning your orders already completed, still in progress or ready to be sent, as well as being able to register your address details and details concerning payment and the newsletter. You undertake to treat personal access data as confidential and to prevent access to it by any unauthorised third party. We can assume no liability for any misuse of passwords, unless we ourselves have dealt with the misuse.

2.3 Collection, processing and use of your personal information

We collect, register and process your data for the full handling of your order (including any services outside the warranty), for our client department, technical administration and the internal requirements of marketing. Your personal data is only forwarded to third parties where this is necessary for the fulfilment of the contract for invoicing or where you have given your prior consent. In handling your order, service providers who we use (such as carriers, logistics providers and banks) receive from us, for example, the data necessary for the completion of the order and its delivery. The data forwarded in this way must be used by our service providers solely for the performance of their tasks. No other use of this information is authorised or takes place by the service providers whom we instruct. Where there is no statutory obligation for us to preserve it, your personal data is deleted if you have expressed your wish for it be destroyed and if it is no longer needed to complete the tasks for which it was recorded, or if its recording is not authorised for any other statutory reason.

2.4 Use of your data for marketing purposes

As well as processing your data for the completion of your purchase from heidi.com, we also use your data to tell you about your orders and certain products, for marketing and to recommend products and services which may interest you. I consent to heidi.com processing and using my personal data for marketing purposes in order to send me marketing information by e-mail and post. You can ask us at any time not to use all or part of your personal data for marketing purposes without this affecting costs other than those of sending out our basic price lists. A simple written statement (e.g. by e-mail, fax or post) is sufficient for this purpose.

2.4.1. Newsletter

For sending out our newsletter we use a procedure called Opt-in; this means we only send you the newsletter if you have confirmed that you want us to activate the newsletter service. If you no longer wish to receive the newsletter or any other marketing messages from us, you can notify us at any time without this affecting costs other than those of sending out our basic price lists. A simple written statement (e.g. by e-mail, fax or post) is sufficient for this purpose. You will of course also find a link permitting you to unsubscribe in each newsletter and product recommendation.

3. Creditworthiness check

In order to offer you the best possible choice of payment options, we have to protect both you and ourselves from abuse. For this reason, we send the personal data necessary for a credit check, including your address, to a credit checking agency. Intrum Justicia SA, Av. Gratta – Paille 2, 1018 Lausanne, carries out an assessment using mathematical and statistical methods. We use the information received concerning the statistical probability of payment default (“probability value”) to decide which payment options to offer to you. If you disagree with the payment method(s) offered as a result of this automated procedure, you can notify us by post or by e-mail using the following address: info@heidi.com. We will re-examine the decision, taking into account your objection. You can at any time object to the forwarding of your data to Intrum Justicia SA, Av. Gratta – Paille 2, 1018 Lausanne. A simple written statement (e.g. by e-mail, fax or post) is sufficient for this purpose. However, we draw your attention to the fact that in this case only the option of prepayment will be offered to you.

4. Cookies

You are not obliged to accept cookies to be able to visit our websites. However, we draw your attention to the fact that use of the shopping basket and product order functions are only possible when cookies are activated.

What is a cookie?

Cookies and flash cookies are small files stored in your computer which, using your Internet browser, memorise certain settings and data in order to exchange it with our system. There are basically two different types of cookies: those called session cookies which are deleted as soon as you close your browser, and temporary or permanent cookies which are retained in your computer over a longer period. This retention helps us to structure our websites and to personalise our product offers and assists your use of the sites, for example by memorising some of your information so that you do not have to keep on repeating the same data entry.

What cookies are used by heidi.com?

Most of the cookies we use are automatically deleted from your hard drive when you close your Internet browser (end of session) - hence the name “browser cookies”. Session cookies are necessary, for example, to enable you to use the shopping basket function even after having visited several pages. However, we also use cookies which remain on your hard drive. When you make your next visit, the system automatically recognises that you have been to our sites before and identifies your preferred entries and settings. These temporary or permanent cookies (lifetime from 1 month to 10 years) are recorded on your hard drive and auto-delete at the end of a specified period. These cookies in particular make our site more user-friendly, efficient and secure for the user. These files mean for example that you can see information especially adapted to your tastes and interests on the sites. The sole purpose of these cookies is to tailor our site as best as we can to your wishes as a client and to make your visit to our sites as enjoyable as possible.

What date is recorded in cookies?

No personal data is recorded in cookies used by heidi.com. The cookies we use cannot be associated with any particular individual. When a cookie is activated, an identity number is assigned to it. No association of your personal data with this identity number is possible at any time. No recording of your name, IP address or any other similar data permitting association between the cookies and you ever takes place. Using cookies, we only obtain anonymous information telling us, for example, which pages of our shop have been visited, which products have been looked at, etc.

I consent to cookies being used and data relating to my site usage being collected, stored and used. I further consent to my data remaining stored in cookies after the end of the Internet browser session and being reused, for example, at the time of my next visit to the websites. I can revoke this consent at any time in the future by configuring my browser’s parameters in order to refuse cookies.

How can I object to the storage of cookies?

In your Internet browser, you can make a setting to refuse any cookies that you do not approve. If you wish to accept cookies from heidi.com but not those from our service providers and partners, you can select the “block cookies from third parties” setting in your browser. In general, the help function in your browser’s toolbar allows you to set how you wish to refuse new cookies and to delete cookies already installed. You will find detailed information telling you how to set the browser parameters that you wish to use in the following link. On computers that are used by several people and configured so as to accept cookies and flash cookies, we recommend that you always end your session correctly as soon as you have finished.

5. Secure data transfer

With us, your personal data is transmitted under full security by encoding. This is not only valid for your order, but equally for your login as a client. For this, we use the SSL (Secure Socket Layer) encoding system. Nobody can guarantee absolute protection. However, we do protect our websites and our other technical and organisational systems against loss, destruction, access to, alteration and distribution of your data to unauthorised persons.

6. Right of access by person concerned

In accordance with federal data protection law, our clients have, inter alia, the right of free access to recorded data concerning them and, where appropriate, the right to correct, bar or delete their data.

We take the protection of your data very seriously. In order to guarantee that your personal data is not sent to third parties, please send your request by e-mail or post, stating clearly that you do not wish your identity to be ascertainable, to:
